Terms of Service

These Terms of Service (“Terms”) govern your use of the website at https://piggybk.app/ and any related services offered by Piggyback (“Piggyback,” “we,” “us”). By accessing the website, joining the waitlist, or — once available — using the Piggyback business messaging service, you agree to these Terms. If you do not agree, do not use the service.
1. Service status
Piggyback is currently in pre-launch. The website at piggybk.app is publicly accessible for marketing, waitlist registration, and product information. The full business messaging service is not yet generally available. Some features described on the website are aspirational and subject to change before launch.
2. Eligibility
You must be at least 18 years old and able to form a binding contract under applicable law to use Piggyback. By using the service, you represent that you meet these requirements.
Use of the messaging service requires that you (a) operate a legitimate business, (b) hold any necessary registrations (e.g., EIN), and (c) only send messages to recipients who have provided express prior consent under applicable law.
3. Acceptable use
You agree not to use Piggyback to:
- Send unsolicited commercial messages (spam) or otherwise violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM, or any state-level analog
- Send messages without explicit, documented opt-in from the recipient
- Impersonate any person or entity, or misrepresent your identity
- Send messages containing prohibited content (sex, hate speech, alcohol-to-minors, firearms-to-prohibited-recipients, tobacco/cannabis where unlawful — “SHAFT” categories)
- Send phishing messages, malware, or attempt to defraud recipients
- Send messages outside applicable quiet-hours windows for the recipient’s state
- Bypass our compliance controls, opt-out handling, or rate limits
- Resell access to Piggyback without our prior written agreement
- Reverse-engineer, scrape, or otherwise misuse the service
- Use the service in violation of any applicable federal, state, or international law
Violation of acceptable-use rules may result in suspension or termination, and you remain responsible for any liability arising from misuse.
4. Consent and compliance
If you use Piggyback to send SMS messages, you are responsible for obtaining and maintaining valid express prior consent from each recipient before sending. You must:
- Disclose what messages will be sent, frequency expectations, and that standard message and data rates may apply
- Provide opt-out instructions in every message (typically “Reply STOP”)
- Honor opt-out requests within a reasonable time (immediately is industry standard)
- Maintain records of consent (timestamp, method, IP address, exact disclosure language) for at least four years following the last message sent
- Not transfer consent: a recipient’s consent to one business does not extend to others
Piggyback provides tools to help you meet these obligations, but legal responsibility lies with you as the sender.
5. SMS messaging consent (for end-users)
If you receive a text message via the Piggyback platform, your phone number was provided to a business with your consent. By providing your number, you agreed to receive SMS messages on the topics disclosed at opt-in. Message frequency varies. Standard message and data rates may apply.
Reply STOP to any message to unsubscribe. Reply HELP for assistance. We will not share your mobile information with third parties for promotional or marketing purposes.
6. Pre-launch waitlist
Joining the Piggyback waitlist via piggybk.app means you have requested early access to the service. We may contact you by email about your waitlist status, launch readiness, and onboarding next steps. You may unsubscribe from waitlist emails at any time.
Joining the waitlist does not create a service contract or guarantee you will receive access to the launched product. Pricing, features, and availability are subject to change.
7. Fees
The website and waitlist are free to use. Once the service is generally available, Piggyback subscriptions will be offered at published rates listed at piggybk.app. Per-message and carrier surcharge fees may apply in addition to base subscription pricing. All fees are described before any charge is incurred.
8. Intellectual property
Piggyback, the Piggyback logo, all website content, design, and software are owned by Piggyback or its licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our materials without prior written permission.
9. Disclaimers
The website and any pre-launch communications are provided “as is” without warranty of any kind, express or implied. We make no warranty of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, Piggyback’s total liability for any claim arising from your use of the website or pre-launch service shall not exceed one hundred US dollars (US $100). In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless Piggyback, its officers, directors, employees, and agents, from any claim, demand, or damages arising from (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) once the service is available, content you send through Piggyback.
12. Termination
We may suspend or terminate your access to the website or service at any time for any reason, including violation of these Terms. Upon termination, sections of these Terms that by their nature should survive (including limitations of liability, indemnification, and dispute resolution) will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Arizona, without regard to conflict-of-law rules. Any dispute arising from these Terms or the service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
